The issue of liquor ban in Bihar has once again taken center stage during the ongoing budget session of the assembly. It has been nearly 10 years since the law was enforced, and now significant voices from both the ruling alliance and the opposition are asking for a change. Leaders like Jitan Ram Manjhi and Upendra Kushwaha have openly questioned the effectiveness of the prohibition, while the Congress party has attacked the government over alleged illegal supplies.

Why are leaders demanding a review of the Liquor Ban?

Jitan Ram Manjhi from the HAM party has termed the current policy as an ‘economic risk’ for the state. He argues that the law often hurts the poor more than the rich, claiming that many poor people are in jail while big smugglers remain free. He has suggested looking at the Gujarat model where some limited exemptions exist.

Similarly, Upendra Kushwaha’s party RLM believes the state is losing massive revenue, estimated between 10,000 to 15,000 crore rupees annually. They also pointed out that tragedies due to spurious liquor (hooch) are still happening in places like Chhapra and Siwan despite the strict rules, making a review necessary.

What are the allegations regarding ‘Home Delivery’?

The Congress party has made serious allegations about the ground reality of the ban. Congress leader Shakeel Ahmad Khan claimed that alcohol prohibition exists only on paper. According to the opposition, a ‘home delivery’ network is active across the state where liquor is available at 3 to 4 times the price compared to neighboring states like UP, Jharkhand, and West Bengal.

Critics argue that this has created a ‘black market’ and a parallel economy. There are frequent allegations that this illegal trade flourishes due to the collusion of local police and administration, defeating the very purpose of the ban.

Current Status and Government Stance

Chief Minister Nitish Kumar remains firm on his decision, stating that the ban has improved the lives of women and poor families since it started on April 5, 2016. He emphasizes the social benefits over the financial loss. The BJP, while officially supporting the government, has some leaders who favor a review to stop corruption.

It is important to note that the rules have seen some changes over time. In 2022, an amendment was made to allow first-time offenders to be released after paying a fine between 2,000 to 5,000 rupees, instead of facing immediate jail time.
