According to the constitution, only the central government has the right to conduct a census.
Patna High Court had given a green signal to the Bihar government on August 1
The Patna High Court had conducted hearings on the questions raised regarding the caste census in Bihar. The bench consisting of Chief Justice Vinod Chandran and Justice Parth Sarthi heard the arguments of the petitioners and the Bihar government for five consecutive days from July 3 to July 7. The court heard the arguments of both sides and then on August 1, the Patna High Court gave a green signal to Chief Minister Nitish Kumar’s dream project. The court allowed it to be conducted like a survey. Following this, the Bihar government resumed the census work in the remaining areas. According to the Bihar government, the caste-based census has been completed.

जातीय गणना को लेकर आज सुप्रीम कोर्ट में आज फिर से सुनवाई होने वाली है। संभवत: आज यह तय हो सकता है कि कोर्ट जातीय जनगणना के डाटा को रिलीज करने का आदेश देगी या फिर रोक लगा देगी। इससे पहले 21 अगस्त को सुनवाई हुई थी। इसमें जातीय गणना पर रोक लगाने की मांग वाली याचिकओं पर कोर्ट ने सुनवाई की थी। जस्टिस संजीव खन्ना और जस्टिस भट्टी की अदालत से सॉलिसिटर जनरल तुषार मेहता ने इसमें 7 दिन का समय मांगा था। इसके बाद 28 अगस्त की तारीख दे दी।
इससे पहले कोर्ट में बिहार सरकार ने दलील देते हुए कहा कि राज्य में सर्वे का काम पूरा हो चुका है। सारे डाटा भी ऑनलाइन अपलोड कर दिए गए हैं। इसके बाद याचिकाकर्ता की ओर से डाटा रिलीज करवाने की मांग की थी। अब कोर्ट इस मामले को सोमवार को फिर सुनवाई करेगी।
NGO ने दायर की हाईकोर्ट के फैसले के खिलाफ याचिका। शीर्ष अदालत की वेबसाइट पर अपलोड की गई वाद सूची के अनुसार, गैर सरकारी संगठन (NGO) “एक सोच एक प्रयास की” ओर से हाईकोर्ट के फैसले के खिलाफ दायर याचिका पर कोर्ट सुनवाई करेगी। NGO के अलावा हाईकोर्ट के फैसले के खिलाफ एक और याचिका सुप्रीम कोर्ट में दायर की गई थी। बिहार के नालंदा निवासी अखिलेश कुमार की ओर से दायर याचिका में दलील दी गई कि जातिगत जनगणना कराने के लिए राज्य सरकार की तरफ से जारी अधिसूचना संविधान के प्रावधानों के खिलाफ है। संविधान के प्रावधानों के मुताबिक, केवल केंद्र सरकार को ही जनगणना कराने का अधिकार है।
पटना हाईकोर्ट ने एक अगस्त को बिहार सरकार को दी थी हरी झंडी। दरअसल, पटना हाईकोर्ट ने बिहार में जातीय जनगणना को लेकर उठ रहे सवालों पर सुनवाई की थी। चीफ जस्टिस के विनोद चंद्रन और जस्टिस पार्थ सार्थी की खंडपीठ ने लगातार पांच दिनों तक (3 जुलाई से लेकर 7 जुलाई तक) याचिकाकर्ता और बिहार सरकार की दलीलें सुनीं थी। कोर्ट ने दोनों पक्षों की दलीलों को सुना। इसके बाद एक अगस्त को पटना हाईकोर्ट ने सीएम नीतीश कुमार के ड्रीम प्रोजेक्ट को हरी झंडी दे दी। पटना हाईकोर्ट ने इसे सर्वे की तरह कराने की मंजूरी दे थी। इसके बाद बिहार सरकार ने बचे हुए इलाकों में गणना का कार्य फिर से शुरू करवा दिया। बिहार सरकार के अनुसार, जाति आधारित गणना का कार्य पूरा हो गया है।
