Central Government Asserts Exclusive Right to Conduct Census

The Central Government filed an affidavit in the Supreme Court saying that according to the Census Act-1948, only the Central Government has the right to conduct the census, not the State Government.

केंद्र सरकार ने सुप्रीम कोर्ट में एक अफिडेविट दाखिल की है जिसमें कहा गया है कि जनगणना अधिनियम-1948 के अनुसार केवल केंद्र सरकार को ही जनगणना का अधिकार है, न कि राज्य सरकार को।

केंद्र ने कहा है कि अधिनियम के धारा-3 के तहत, केंद्र को कानून के तहत यह अधिकार मिला है, जिसमें केंद्र सरकार की ओर से एक अधिसूचना जारी करके घोषित किया गया है कि देश में जनगणना की प्रक्रिया चल रही है और उसके आधार भी स्पष्ट किए जाते हैं।

अफिडेविट में केंद्र ने कहा है कि संविधान में कोई और संघटना या निकाय जैसे जनगणना या गणना के लिए कोई और अधिकारी नहीं है।

केंद्र सरकार ने सुप्रीम कोर्ट को यह भी बताया कि सरकार द्वारा एससी, एसटी और ओबीसी के कल्याण के लिए संविधान और कानून के अनुसार सभी आवश्यक और उचित कदम उठाए जा रहे हैं।

जनगणना एक विधायी प्रक्रिया है, जो जनगणना अधिनियम 1948 के तहत होती है और केंद्र सरकार को इसे आदेश 69 में केंद्रीय कार्यक्रम की 7वीं क्रमशः आयोजित करने का अधिकार है।
