High Court Orders Son to Provide Monthly Allowance to Father

In a recent order, the Jharkhand High Court has stated that the position of a father is higher than heaven. It is the duty of a son to repay his father’s debt. With this comment, the court has ordered a son to provide his father with a monthly allowance of 3,000 rupees. Along with this, the court has deemed the decision of the lower court as correct and dismissed the petition of the son, Manoj Sawh.

Court Cites Mahabharata to Highlight the Importance of Father

In its order, the court has referred to a question-answer dialogue between Yaksha and Yudhishthira in the Mahabharata. Yaksha asked Yudhishthira, “What is heavier than the Earth? What is higher than heaven? What is swifter than air? What is more numerous than grass?” To this, Yudhishthira replied, “The mother is heavier than the Earth, the father is higher than heaven, the mind is swifter than air, and our thoughts are more numerous than grass.” Justice Subhash Chand’s court, while explaining this, ordered the son to fulfill his sacred duty.

The Entire Case

The Family Court of Koderma had previously ordered Manoj Sawh to provide a monthly allowance of 3,000 rupees to his father. Manoj had appealed against this order in the High Court. During the hearing, it was stated that the father owns some agricultural land but is unable to cultivate it. He is dependent on his elder son, Pradeep Kumar Sawh, who he lives with. The father has given an equal share in his entire property to Manoj, but for over 15 years, the son has done nothing for his father’s support. The father stated that Manoj runs a shop in the village, earning 50,000 rupees per month from it. In addition to this, he also earns an extra 200,000 rupees per year from the agricultural land. Based on this, the court ordered the son to provide a monthly allowance of 3,000 rupees to his father. Manoj, the younger son, had sought refuge in the High Court against this decision.

झारखंड हाईकोर्ट ने एक आदेश में कहा है कि पिता का दर्जा स्वर्ग से भी ऊंचा है और पिता का ऋण चुकाना पुत्र का कर्तव्य है। अदालत ने एक बेटे को अपने पिता को हर माह तीन हजार रुपए गुजारा भत्ता देने का आदेश दिया। अदालत ने इस आदेश के साथ ही निचली अदालत की याचिका खारिज कर दी। अदालत ने महाभारत के उदाहरण के माध्यम से बेटे को अपने पिता के पवित्र कर्तव्य का पालन करने का आदेश दिया। अदालत ने कहा कि माता-पिता के साथ बेटे को आश्वस्त महसूस करना चाहिए और उनके दुःख में भी सहभागी बनना चाहिए। अदालत ने कहा कि माता-पिता बीज हैं और बेटा पौधा है, इसलिए उनके अच्छाई और बुराई दोनों का विरासत में मिलता है। इसके साथ ही एक व्यक्ति पर जन्म लेने के कारण कुछ ऋण होते हैं और इसमें पिता और माता का ऋण भी शामिल होता है, जिसे चुकाना होता है। इसमें बेटे को अपने पिता को मासिक गुजारा भत्ता देने का आदेश दिया गया है।
