Patna High Court’s Landmark Decision
Patna High Court has made a significant decision stating that a husband cannot divorce his wife on the grounds of her inability to conceive after marriage according to Hindu customs and traditions. The court ruled that the husband cannot base divorce on the wife’s incapacity (failure to conceive).
Court’s Verdict
The court stated in its judgment that there is a physical defect in the appellant’s body. If evidence is provided before the trial court to prove this, and if the allegation is proven, it can be a basis for canceling the marriage under Section 12 of the Hindu Marriage Act. The court emphasized that divorce cannot be based on mere allegations.
Jamui Family Court Order Cancelled
Patna High Court cancelled a divorce order passed by the Jamui Family Court. The bench comprising Justice P.B. Majmudar and Justice G. Anupama Chakravarti delivered this order. The decision was made while accepting the appeal of the aggrieved wife from Jamui. The court has sent the case back to the relevant family court for further proceedings.
Allegations of Infertility
The husband had accused his wife of being infertile and divorced her on that basis, claiming that sexual relations were not possible due to her lack of reproductive organs. However, since the divorce was granted without hearing the wife’s side, the High Court found that the divorce order was a clear violation of the principles of natural justice.
पटना हाईकोर्ट ने हिंदू रिति-रिवाज से शादी होने के बाद पत्नी का प्रजनन अंग नहीं होने पर तलाक नहीं लेने का फैसला दिया है। इस निर्णय में कहा गया है कि पति के लिए पत्नी की अक्षमता पर आधारित तलाक नहीं हो सकता। यह फैसला जमुई परिवार न्यायालय द्वारा पारित तलाक के एक आदेश को रद्द करते हुए दिया गया है। अब पति-पत्नी के बीच जमीनी समस्याओं का समाधान संभव हो सकता है।
