Bihar High Court’s Important Decision on Reinstatement of Untrained Teachers
The Bihar High Court has made a significant decision regarding the reinstatement of untrained teachers. The order from the High Court states that teachers currently employed under the education department may be affected by this decision. Especially at risk are those teachers whose reinstatement occurred after March 31, 2015 as their jobs are now in jeopardy. It is important to note that since 2015, 17,000 Urdu untrained teachers have been reinstated, along with 3000 teachers who have not completed their training.
Key Points of the High Court’s Order
The High Court’s order dated March 20, 2024, states that teachers who have not completed their training by August 8, 2021, may be dismissed from service. Additionally, untrained teachers whose appointments were based on compassion have been directed to be given fourth-grade jobs. Furthermore, all untrained teachers appointed after March 31, 2015, have also been ordered to be dismissed from service.
Will the Teachers be Dismissed?
The executive president of the Bihar State Elementary Teachers’ Association, Manoj Kumar, has expressed concern over the order to dismiss reinstated teachers after 2015. He believes that this decision is not in the best interest of the teachers. On the other hand, Amit Vikram, the state president of the Bihar School Teachers’ Association, has suggested that untrained appointed teachers who are at risk of dismissal should also be allowed to continue in service. The High Court has provided a window for those teachers who have completed the required training by August 8, 2021, to retain their appointments.
