Recent Incident of Child Abuse in Bihar

Recently, in Ara, Bihar, a school teacher physically assaulted a student, causing swelling in the child’s hand. The parents of the child filed a case against the school principal and teacher at the Jagdishpur police station, highlighting the issue of child safety and adherence to school rules. This incident has raised concerns about the safety of children in schools and the need to enforce regulations.

Guidelines for Child Safety in Schools

The President of the Private School Association in Ara, Smita Singh, emphasized that teachers and school administrators should not resort to physical violence against children. Instead, they should be disciplined with love or face minor consequences without causing physical harm. The CBSE has issued guidelines regarding child safety, emphasizing the importance of staff verification, safety audits, and the establishment of committees to address issues like sexual harassment. Schools are now responsible for ensuring the safety of children under their care.

Legal Actions Against Child Abuse in Schools

Under the Right to Education Act, Section 17, disciplinary action can be taken against teachers who harass students mentally or physically. Parents, principals, or the education department can file complaints against errant teachers. Additionally, provisions under the IPC allow for legal action against perpetrators of child abuse, including reporting to the National Commission for Protection of Child Rights and state education departments. Any form of harassment or corporal punishment against children is strictly prohibited and can lead to severe consequences for the guilty party.
