Based on this, he announced the full schedule of the Assembly. He is also the chairman of the committee related to the rules of the Assembly. It remains to be seen whether the notice submitted to the Secretary of the Assembly on January 28 for a motion of no confidence is effective. The Speaker remains in power for 14 days with a motion of no confidence, so the new Cabinet scheduled the start of the session from February 12 based on the notice.
If the Assembly session begins on Monday, Article 179 will be extensively discussed. This article is related to the vacancy, removal, or resignation of the Speaker and Deputy Speaker of the Assembly. The government will initiate the session with a vote on the motion of no confidence against Avadh Bihari Choudhary, in accordance with this rule, 14 days before. If the government obtains a majority in passing the motion of no confidence against Choudhary, they will ask the Deputy Speaker to resign. If the removal of Avadh Bihari Choudhary is put to a majority test, the Deputy Speaker can end the need for a majority test for the Nitish Kumar government. The significant point is that if a motion of no confidence is brought against the Speaker, the Deputy Speaker will handle the proceedings in the absence of the Speaker. Even if Choudhary remains in his position forcibly during this process, he will have to step down if there are more votes against him. If the ruling party cannot bring a majority to remove him, it will be assumed that the government will not survive either.
