The Patna High Court stated that there is no provision in the latest service rules for appointed teachers (Panchayat teachers) which says that teachers who fail to pass the competency exam will be removed from their services. The High Court made this comment while disposing of several petitions on Tuesday. The bench of Chief Justice Vinod Chandran and Justice Harish Kumar said that those who have passed the competency exam will have better service conditions. Better service conditions only validate their competence. Additionally, those who could not pass the exam or refused to take it, their jobs will still continue.

Specific Teacher Rules 2023

Under the Specific Teacher Rules 2023, around 3.5 lakh contractual teachers in Bihar’s government schools will attain the status of government employees after passing the competency exams. It is mandatory to pass the competency exams to attain the status of government employees under the Specific Teacher Rules 2023 in Bihar. Each teacher is given five attempts to pass the exam, three online and two offline. Even those who fail the competency exam under the Specific Teacher Rules 2023 cannot be dismissed.

Appointment of Teachers

The appointment of appointed teachers was done under the Bihar Panchayat Primary Teacher (Appointment and Service Conditions) Rules, 2006 (briefly the Primary Teacher Rules 2006) and later regulated by the Bihar Panchayat Teacher Rules, 2012 (briefly ‘Panchayat Teacher Rules-2012).

Cabinet Minister’s Statement

JDU senior leader and Bihar’s Minister of Parliamentary Affairs, Vijay Kumar Chaudhary, reacted to the Patna HC’s orders. He stated that the state government never thought of dismissing those appointed teachers who could not pass the competency exam or did not participate in the exam. He mentioned that there were some misleading information circulating regarding the appointed teachers and the Specific Teacher Rules 2023, and the High Court has issued orders to put a stop to this misleading information.



पटना उच्च न्यायालय ने नियोजित शिक्षकों के लिए नवीनतम सेवा नियमों में कोई प्रावधान नहीं है जिससे सक्ष्मता परीक्षा में असफल रहने वाले शिक्षकों को उनकी सेवाओं से हटाया जाए। उच्च न्यायालय ने यह निर्णय मंगलवार को लिया और कहा कि सक्ष्मता परीक्षा में अनुत्तीर्ण होने वाले शिक्षकों को नौकरी से निकालने का कोई प्रावधान नहीं है। इसके अलावा, विशिष्ट शिक्षक नियम-2023 के तहत सक्ष्मता परीक्षा में अनुत्तीर्ण होने वाले शिक्षकों को भी बर्खास्त नहीं किया जा सकता। बिहार सरकार ने इस निर्णय का समर्थन किया है और ब्रह्मक जानकारियों पर रोक लगाने का आदेश दिया है।
